1909 年 5 月 10 日,西雅图市议会批准公园委员会的请求,请求启用法定征用程序获取贝利 (Bailey) 半岛,作为将要建设的苏厄德公园场地。1908 年,西雅图市与该地产所有者开始谈判此交易,但最终因价格问题未能达成协议。该市通过实施土地征用权(政府将私有房地产收归作为公用的权力),宣判政府对 该地产的所有权,价格由独立的第三方鉴定人确定。
